The BJP’s Fake
News Brigade on Recent Amendments to the Indian Succession Act
Shrikant G. Talageri
After my earlier article, “Non-Muslims in Mumbai, Kolkata and Chennai, Your Property Is Not Your Own To Will Away Without Court Probate”, yesterday a BJP supporter friend I met on the road called out to me that he was expecting “pedhas” from me. I asked him why. His reply was that what I had written in that article no longer applies because after recent amendments to the Indian Succession Act, both the compulsory or mandatory Court Probate required for the transfer of property of non-Muslims in Mumbai to the nominee as per a Will, has been removed, and that now the same rules apply to people of all religions.
I immediately searched for this alleged news on Google but could not find it whichever way I framed the search. Finally, I went for direct questions, and got the answers as follows:
As per recent amendments to the Indian Succession Act is it still mandatory for a Hindu in Mumbai to get a will probated by the court before property is transferred to the nominee?
AI Overview Reply:
“Yes, as per the current
law, it is still mandatory for a Hindu in Mumbai to get a will
probated by the High Court if the will involves immovable property located
within Mumbai. This requirement is a long-standing provision under the Indian
Succession Act, 1925, and has not been removed by recent amendments to other
succession laws”.
As per recent amendments to the Indian Succession Act is
it now mandatory for a Muslim also in Mumbai to get a will probated by the
court before property is transferred to the nominee?
AI Overview Reply:
|No, it is not
mandatory for a Muslim in Mumbai to get a will probated by the court
before property is transferred to the nominee.
The legal position remains unchanged, even
with recent discussions around amendments to the Indian Succession Act, 1925.
Section 213(2) of the Act specifically exempts wills made by Muslims
(Muhammadans) from the compulsory requirement of obtaining probate”.
Allahu Akbar: God is Really Great! In the land ruled by the Vishwa Guru, no law discriminating against Hindus and reducing them to the level of Eighth Class Citizens in India will ever be changed. However, if I go by the fact that Syed Shahabuddin was the only MP who tried to bring an amendment to provide the benefits of articles 25-30 of the Constitution equally to the followers of all religions (iucluding Hindus), I feel more hopeful that there will be greater Justice and Equaliity for (the remaining) Hindus in India when India becomes an openly Islamic state in 50-100 years.
